Darulifta Ahlesunnat
(Dawateislami)
Question
What do the noble scholars and the jurist of Islamic law say regarding
the following matter:
Is it permissible to
use a Miswak that foams whilst fasting? Further, is it permissible to use
Toothpaste whilst fasting?

اَلْجَوَابُ بِعَوْنِ الْمَلِکِ
الْوَھَّابِ اَللّٰھُمَّ ھِدَایَۃَ الْحَقِّ وَالصَّوَابِ
It is permissible to use all
kinds of Miswaks whilst fasting. Fast is not nullified by using it, rather,
doing miswak is sunnat whilst fasting, just as it is
Sunnah in the other days, but bear in mind, that if a person remembers that he
is fasting and the bristles of miswak breaks upon chewing it or the taste is
felt, then one should avoid chewing it.
Moreover, although using toothpaste is not impermissible and Haram
[prohibited] when fasting, but using it without a valid need, is certainly Makrooh and because there is more likelihood that some bits
of toothpaste might go down the throat, therefore it should definitely be
avoided.
